With the advent of the Internet age,the sharing economy has developed rapidly.The sharing economy uses big data to integrate economic resources,which not only forms a variety of new activities and new business models,but also creates a large number of flexible employment opportunities,and a large-scale Gig Workers employment group emerges.The sharing economy has a huge impact on traditional labor relations while absorbing a large amount of labor forces,placing higher requirements on the harmonious development of labor relations in the context of the sharing economy.This research is based on Marx's theory of employment labor relations and the theory of socialist harmonious labor relations with Chinese characteristics.It forms an analysis framework for the protection of workers'rights and interests in five areas: labor compensation,rest and vacation,labor safety and health,social insurance,and vocational skills training.Analyze the employment characteristics of Gig workers in the context of the sharing economy,and explore the current status of the rights protection of Gig workers,the outstanding problems and their causes,thus put forward countermeasures and suggestions to promote the orderly development of the sharing economy and protect the rights and interests of Gig workers.The conclusion of this study are as follows: In the context of the sharing economy,the employment of Gig workers has the characteristics of flexible and changeable labor methods,multiple coexistence of employment methods,multiple nature of employment relationships,and large income uncertainty.The protection of the rights of online contract workers is very important.At this stage,the rights and interests of Gig workers are still not guaranteed,such as inadequate labor compensation guarantees,rest and vacation guarantees,insufficient labor safety and health protection,low social insurance coverage and lack of vocational skills training.There are institutional obstacles to the protection of the rights of Gig workers,the lagging of the construction of the labor dispute coordination mechanism,the lack of independent rights protection organizations for the group of Gig workers,and the lack of consumer tolerance for Gig workers.The reason is that the incomplete labor employment and social security system is an institutional factor,and the government's weak supervision of the new format of labor law enforcement is the law enforcement factor,and the lack of flexible employment and rights protection capabilities of the workers is the internal subjective factor.Demand and irregularity are external subjective factors,and these factors have led to the current difficulty in ensuring the rights and interests of Gig workers.Based on this,countermeasures and suggestions for protecting the rights and interests of Gig workers under the background of the sharing economy are as follows:Strengthen the construction of labor laws in the sharing economy,provide institutional basis for the labor rights protection of Gig workers,strengthen the government's labor law enforcement and supervision,promote the healthy development of labor relations,improve the ability of workers to organize rights protection,and provide organized rights protection channels for Gig workers.Improving the professional skills of Gig workers,promoting Gig workers 'employability,strengthening the responsibility of the sharing economy's business,and promoting the fulfillment of their duties to protect Gig workers' rights.These are the proper choices to realize the sharing of economic development and the protection of labor rights of Gig workers,and to promote the harmonious and stable development of labor relations.
