| In recent years,with the development of information technology and the comprehensive promotion of big data and mobile Internet,the platform economy and sharing economy have achieved great development,and the new employment form relying on the development of the Internet platform has created a large number of flexible employment opportunities with its flexibility,loose organization and task-oriented characteristics,which is an important factor to promote the stable development of the current and future labor market.However,while the new employment form brings a large number of jobs and solves the employment problem of a large number of newly employed people,its development also faces the dilemma that the construction of the labor rights and interests protection system of workers is not perfect.Therefore,it is of great significance to carry out research on the protection of labor rights and interests of flexible employment personnel under the background of new employment forms,which is of great significance to promote the standardized and healthy development of new employment forms and maintain social harmony and stability.Based on the collection and collation of literature on the protection of labor rights and interests of flexible employees at home and abroad,this paper takes special riders as the main research object,and adopts the research methods of participatory observation and semi-structured interviews to empirically analyze the current situation of labor security rights and interests of flexible employment personnel in new employment forms,based on the perspective of labor market segmentation theory and risk perception theory.The investigation and analysis of specific dimensions such as vocational training and security services concludes that the protection of labor rights and interests of flexible workers in new employment forms mainly faces the following problems: first,the lack of standardized management of the secondary labor market in which workers live,mainly including the unilateral and incomplete nature of the formulation of contract content,workers lack the right to negotiate working conditions,third-party labor dispatch organizations have management chaos,the platform blurs its labor relationship with workers,thereby weakening its employer’s responsibility.Second,workers face various occupational risks,mainly including risks caused by the lack of social insurance,risk of loss of occupational injury coverage,risk of absence of occupational benefits.Third,the application of platform algorithm technology puts workers in a false and free labor environment,mainly including high-intensity labor under the supervision of platforms,third-party labor dispatch organizations and consumers,the normalization of emotional labor.In view of these problems,this paper systematically discusses the causes of the dilemma of labor rights protection of flexible employment personnel under the background of new employment forms,mainly including the following three aspects: first,the lack of human capital of flexible employment groups under the influence of labor market segmentation factors,the squeeze of the urban-rural dual division system,the lack of effective protection of trade unions,and the deviation between government support policies and implementation.Second,the lack of risk perception of platform enterprises and flexible employment workers.Third,the pursuit of user scale and stickiness by platform enterprises squeezes the labor rights space of workers,which is mainly manifested in the time squeeze and emotional squeeze of workers.Based on the above analysis,this paper puts forward countermeasures and suggestions for solving relevant problems,in order to provide reference and reference for the protection of labor rights and interests of flexible employees under the background of new employment forms. |
