Research On Legal Relation Of Network Employment

Along with the vigorous development of the Internet sharing economy,a large number of new employment models based on “platform + individual” have gradually emerged.Using network platform enterprises as the main platform,through internet and mobile payment technology,network employment is established.This emerging model called“sharing economy” is booming during promotion of the Internet technology.From the perspective of diversified network employments,this paper mainly analyzes different legal characteristics between the network employment and the traditional employment model.Fully integrated the national conditions and the characteristics of sharing economy,the author explores ideas on establishing diversified employment models between network platforms and gig workers based on the current judicial situation and dilemma in China.Starting from the principle of “flexibility and safety” for employment relationship,and the perspective that protection of labor rights should be hierarchical,the author tries to discuss and formulate the legal relation identification standards of diversified new network employment according to different network platforms and new business models.It will help the development of the sharing economy and also provide basic protection to potential gig workers by identifying reasonable allocation of the rights and obligations of network platforms and gig workers,and establishment of appropriate legal relation identification standards.Attention from the academic and judicial communities will not only enhance research and practice in this field,but also will promote the development and improvement of legal labor relation in employment based on network platforms.
