Research On Intellectual Property Risk Prevention And Control System Of China's White Liquor Manufacturing Industry

Chinese white liquor manufacturing industry will face various kinds of intellectual property risks in production and operation activities.These risks will lead to loss of economic benefits and problems in operation.Today intellectual property rights have been paid more and more attention.Because the characteristics of white liquor manufacturing industry are different from the science and technology enterprises,its intellectual property rights are still relatively backward,especially the lack of a complete intellectual property risk prevention and control system.That will cause the loss of all aspects of enterprise.Shanxi Fenjiu is one of Chinese four major wines with a long history of brewing.It is the representative of northern liquor.Shanxi Fenjiu has developed rapidly in recent years and it lead into the tide of reform of state-owned enterprises.It is representative and researchable.This paper take the Shanxi Fenjiu Group Ltd as a study case to research the risk prevention and control system of intellectual property rights in Chinese liquor industry.The first chapter is mainly about the research background and research method of the paper and the paper review of the liquor manufacturing industry intellectual property risk prevention and control.The main research methods used in this paper are case analysis,field investigation and literature research.This paper reviewed the research results of this field by four perspectives: the types of white liquor;the geographical distribution of white liquor;the object of intellectual property and the legal perspective.The second chapter is mainly about status of China's liquor manufacturing industry intellectual property prevention and control system.Take the data of Maotai,Wuliangye,Fenjiu,Luzhou Lao Jiao and other ten representative enterprises to research the risks of intellectual property of Chinese liquor industry in intellectual property patent,trademark,copyright,trade secrets,intangible cultural heritage,geographical indications and other aspects and analyze the imperfect of Chinese liquor industry risk prevention and control system.The third chapter and the fourth chapter study the intellectual property data of the patent,copyright,trademark,trade secret and intangible cultural heritage of Shanxi Fenjiu Group and study the calendar mechanism and system of intellectual property risk prevention and control system.Then we found some problems in it: first,the absence of intellectual property protection awareness;second,intellectual property management system is not perfect;third,the lack of intellectual property system;fourth,a small number of intellectual property rights with low quality;fifth,the operation of intellectual property is insufficient.In the fifth chapter,the paper put forward the following suggestions according to the investigation results of Shanxi Fenjiu Group and the problem of Chinese liquor industry intellectual property risk prevention and control system construction: first,establish intellectual property management departments according to the specific situation of liquor manufacturing industry.The large liquor companies establish intellectual property management departments directly under the headquarters.The small and medium liquor enterprises establish intellectual property management departments under the legal department.Second,establish and improve the intellectual property management system,including intellectual property rights incentive system,intellectual property management system,and intellectual property archives management system.Third,improve the staff's awareness of intellectual property protection by propaganda,training,case explanation and other ways.Fourth,promote the operation of intellectual property,such as establishing patent pool of liquor industry,establishing value assessment system of industrial intellectual property and so on.
