On The Coordinated Development Of Citizens' Environmental Supervision Power And State Environmental Administrative Power

Developing and improving the civil environmental supervision rights is of great significance for strengthening environmental protection.It is an objective requirement to practice people-centered development concepts,is to improve the realistic requirement of environmental governance system and governance capacity,and is also the important measure to build a service-oriented government.The object of environmental supervision rights of citizens mainly includes two kinds:first,any unit or individual pollutes or destroy ecological environment;second,administrative organs exercise the state environmental executive power in accordance with the law.The main contents of the state environmental executive power can be summarized as follows:include environmental administrative license,environmental administrative punishment and environmental administrative compulsory.In recent years,the operation of state environmental administrative power has achieved good results.The pollution control effect is remarkable,and the ecological environment has been gradually improved.At the same time,citizens exercised environmental supervision rights,that is,citizens complained and reported enterprises irregularities and illegal activities,and governments environmental executive "nonfeasance" and "disorder feasance" to relevant state organs.It provides law enforcement clues to solve environmental problems,and helpful to urges environmental administrative organs to fulfill their duties.The coordinated development between civil environmental supervision rights and the state environmental administrative power should be achieved,which exerts great significance on promoting ecological civilization construction;however,in reality,there are still some problems such as the lack of awareness of civil environmental supervision rights,short of complaint reporting system for citizens,deficiency of supervision safeguards system and environmental supervision laws and institution needs to be improved.The realization of the coordinated development should be implemented from these respects:first,citizens and environmental executive organs should improve the supervision awareness;second,the complaints and reporting system of citizens and supervision safeguards system should be improved;last,environmental supervision laws and institutions should be corrected.
