Research On Public Participation In Environmental Administrative Decision-making

Since the 17 th National Congress of the Communist Party of China,it has gradually emphasized the improvement of the social governance system.The public participation system is one of the important contents of the social governance system.Public participation in environmental administrative decision-making is an important part of the public participation system,and it has important significance in the improvement of the social governance system.In this paper the status of domestic and foreign research is analyzed by combing relevant literatures,and social research methods such as literature research,statistical analysis and comparative research is used from five aspects: theory,legislation,practice,extraterritorial reference and improvement path.The shortcomings of public participation in environmental administrative decision-making in terms of subject,scope,methods and procedures etc.is indicated.Combined with the actual situation in China,the feasible suggestions for improving the public participation in environmental administrative decision-making in China is proposed.Chapter 1 is Introduction.The background and basis of the topic is introduced,the research status at home and abroad and the three research methods used is introduced in this part,which lays the foundation for the later paper.Chapter 2 is Theoretical Research.By defining the public participation of environmental administrative decision-making and its related concepts,the key terms are clarified,and that public participation in environmental administrative decision-making has the value of preventing environmental conflicts,safeguarding environmental rights and realizing environmental rule of law is indicated.The theoretical basis includes the theory of deliberative democracy,procedural justice,environmental rights and social governance,which can be classified into two different modes: government-led and social cooperation,depending on the participation rights and participation methods.Chapter 3 is Legislative Research.Based on the relevant laws and regulations in China,the legislative status of the public participation in the environmental administrative in terms of the main body,scope,methods,procedures,etc.is described,and that the public participation in the environmental administrative decision-making is not the content of the subject rights,that the scope of participation is narrow,that the diversity of participation methods is lacking,and that the participation procedures are not perfect is found out.Chapter 4 is Practice Analysis.By using the questionnaire survey method and the interview method to study the practice status of public participation in environmental administrative decision-making in China.In practice,there is a low proportion of participation,insufficient innovation of participation methods,and the participation effect is worrying.Based on this,the causes of the problem are further analyzed.Chapter 5 is Extraterritorial Reference.By finding useful experiences of other countries in the subject,scope,methods and procedures of public participation in environmental administrative decision-making,and drawing lessons from China's actual situation to expect to provide reference for China.Chapter 6 is Improvement Research.From the three aspects of concept renewal,system improvement and improvement of supporting measures,it is expected to provide countermeasures for the problems of public participation in the legislation and practice of public participation in environmental administrative decision-making in China.Chapter 7 is Conclusion.It is pointed out that it is necessary to rationally use the two modes of public participation,government-led and social cooperation,to continuously improve the public participation in environmental administrative decision-making in China from both legislative and practical aspects.
