Research On The Responsibility Of Soil Pollution Remediation Of Agricultural Land In My Country

Soil pollution is different from other types of pollution,it is long-term and latent,and it is easy to cause other pollution,pollute groundwater and threaten human health.According to the different pollution sites,soil pollution can be divided into agricultural land pollution and industrial enterprise site pollution.Among them,agricultural land refers to the land used for agricultural production,including cultivated land,woodland and pastureland,etc.The health of agricultural land is directly related to the survival of farmers and the food security of the country,and it is very important to prevent and control the soil pollution of agricultural land.Because agricultural soil pollution in China is caused by agricultural non-point source pollution,industrial enterprise pollution,air deposition and other reasons,the pollution types are more complex and diverse.Once agricultural land is polluted,the difficulty coefficient and harmfulness of its treatment and restoration are great.On January 1,2019,China promulgated and implemented the Law on soil pollution Prevention and Control,which marks the establishment of a systematic soil pollution prevention and control system in China.In the law "risk control and remediation ",the problem of soil pollution in agricultural land is specially stipulated,use of agricultural land as a special "risk control and repair" object,but there are some problems in the implementation process.The primary problem is who is responsible for remediation,that is,the identification and responsibility of the main body of pollution.Because agricultural land pollution is different from construction land in pollution source,liability determination and so on,there are some specialities.In practice,the identification and investigation of soil pollution responsibility for agricultural land is more complicated and controversial,so it is urgent to clarify and solve it.To sum up,This paper introduces the current situation of soil pollution in agricultural land in China,the diversity and complexity of the sources of pollution,analyzes the soil pollution situation of agricultural land,and analyzes the necessity and urgency of its treatment and repair.On this basis,the connotation and nature of the responsibility for soil pollution remediation of agricultural land are defined,the attribution of the responsibility for remediation is clearly defined,and the relevant cases of agricultural land pollution in practice are summarized and analyzed in combination with the existing legal provisions,which points out that there are some problems in the application of the responsibility for soil pollution remediation of agricultural land in China,such as the difficulty of determining the responsibility subject,the unreasonable order of responsibility,and the confusion of responsibility investigation mechanism.In view of the above problems,we should draw lessons from the successful experience of other countries' agricultural land regulation system according to the actual situation of our country To improve the rules for determining and investigating the responsibility for soil pollution in agricultural land by clarifying the scope of the main body of responsibility,adjusting the rank of the main body of responsibility and perfecting the mechanism of accountability.
