The combination of psychology and criminal procedure law is a hot topic in the field of law.The analysis of the formation of criminal misjudged cases from the perspective of cognitive psychology is conducive to exploring the underlying causes behind criminal misjudged cases.The ability of judicial personnel to handle case information is limited and can easily lead to various psychological biases in judicial activities.The psychological reason for the formation of criminal misjudged cases is induced by the combination of the subjective psychological factors of the judicial personnel and the objective factors of the judicial system.In criminal proceedings,psychological reasons continue to accumulate and migrate,presenting a progressive process of production.In the process of production,psychological reasons imperceptibly influence the behavior of judicial personnel,erroneously guide judicial activities,and cause a large number of criminal misjudged cases.Therefore,the psychological reason is the deep reason for the formation of criminal misjudged cases.In view of the frequent psychological problems of judicial personnel,specific measures for preventing and correcting the psychological reasons for the formation of criminal misjudged cases are proposed from the perspectives of judicial personnel,judicial system and external judicial environment.The reform measures include: establishing a judicial concept of presumption of innocence,strengthening the training of cognitive psychology,implementing a criminal investigation system,and establishing a reasonable internal assessment mechanism.
