Small property housing refers to the construction of collective non agricultural land,due to the non payment of fees and other fees,can not receive the relevant departments of the state issued by the housing property certificates,only rural,village government issued a certificate of housing.The construction of such housing is legal,but not allowed to enter the market directly according to the law of the state.However,because of the expansion of the city,the housing price is too high,and the rural industry and labor adjustment factors,the small property right housing transactions in reality is a large number of.However,because of the lack of legal protection and regulation,there are many problems in the practical operation,causing a large number of disputes and litigation,is not conducive to maintaining the market order and social stability.Therefore,it is urgent to explore the way of the legalization of small property right house and to formulate and improve the relevant laws and regulations.The fundamental reason for the legalization of small property right housing transactions is that the urban and rural land system has been implemented in China for two years,and the ownership and use right of the collective land is divided by the people.Thus,the rural collective economic organization and its members(farmers)can not exercise full disposal and the right of return on all the land of the collective organization.And according to the registration policy of housing and land,the construction of small property housing on the collective land,even though the construction itself may be legal,but also not foreign sales.The legalization of small property rights house is full of legal principle and social needs.The biggest obstacle to its realization,in fact,is the distribution of economic interests.To discuss the way of the legalization of small property house,in a way,is to balance the interests of the state,local government and the rural collective economic organizations and their members.This is the practical difficulty to solve the problem,need to put forward some concrete and feasible solutions,and only in this way,can promote the legalization of small property housing transactions,maintain social stability and economic development.
