The Legal Obstacles And Countermeasures Of Rural Land Trust

This paper analyses the formation of the land trust and elaborates systematically the theory basis of the rural land trust,compares with the advantages and disadvantages of the current models of the rural land trust Studies,discusses the impediments of the rural lands trust in current stage,and further puts forward the corresponding resolution strategies,in order to provide a reference for the perfection of the means of circulation of the rural land trust of our country.The first chapter discusses the theoretical basis of the rural land trust system;First,the origin of the ancient Egyptian trust,Roman "heritage trust",and the modern English land trust form a development sequence of the rural land trust;meanwhile,the research on the development of the rural land trust in our country shall have a positive impact on the understanding the right path of development of the rural land trust on a macro level;Second,Next,to define the connotation of the rural land trust.Last,this paper discusses the function of the rural land trust.The second chapter analyses the classic cases of rural land trust,highlighting the advantages of the rural land,to explore the legal issues under the rural land trust.The third chapter elaborates legal impediments and the reasons of the rural land trust.This paper mainly discusses the unclear property ownership,the indecisive legal status of the land joint stock cooperation system,the imperfect incentive mechanism for the trustee and the loophole of the land trust supervision.The fourth chapter puts forward the countermeasures of the problems of the rural land trust,after the analysis of its impediments and reasons,in order to provide legal support for the rural land trust.The main strategies are to clarify the property ownership for the smooth circulation of land trust,to confirm the legal status of the land joint stock cooperation system,to perfect the incentive mechanism for the trustee and to establish a multi-level supervision system of land trust.
