On The Improvement Of Our Country's Criminal Victim Assistance System

The third plenary session of the 18th CPC focused on building and improving the judicial relief system,and the relief system for criminal victims is one of the important components.Recently,with the continuous promotion of rule of law in our society,people give full attention to the protection of criminal victims.In order to guard the legal rights of criminal victims,many countries make laws and rely on state aid to make the relief system work.Compared with the outside,our country has not established a uniform relief system for criminal victims,and there lacks one set of laws for the system.Although Chinese government issued relevant documents on the aid work,the problem is the papers focused more on guidance not legally enforced.Therefore,those regions which in the process of providing assistance for criminal victims always has their own ways to deal with problems.Under the circumstances,to improve relief system for criminal victims is imminent in China.This paper adopts the method of data analysis and comparative analysis.On the basis of demonstrating the relief system for criminal victims,discussing the present situations and problems of the system in China,actively referring to those successful experience of foreign relief system for criminal victims and relevant legislation to come up with suggestions of legislation as well as the four concrete contents in our relief system.In addition to the introduction,this paper is generally divided into four parts:The first part mainly demonstrates the relief system for criminal victims.Through introducing the definition of criminal victims,relief system and functions of system,define the orientation of relief system in this article.The second part is about current situations and problems of relief system in our country.From the current relief legislation status to analyze the reality of the current system.Then it discusses the present shortage of relief system in the aspect of legislation and several concrete contents:objects and scope,relief agencies,source of funds,aid standards and legal aid.The third part is the reference from foreign legislation.According to the analysis of many countries and regions' legislation and measures on relief system for criminal victims,this part devotes itself to learn valid and feasible ways to improve relief system for criminal victims in our country.The fourth part is about opinions of improving relief system for criminal victims in our country.The paper puts forward suggestions of legislation as well as the four concrete contents in our relief system.Among them,there gives suggestions of adjusting relief object and scope including the help and the victims whose property damaged in crime;In terms of relief agencies,there recommends referring to the relevant provisions of the standard setting of relief agencies according tc the Charity Law of People's Republic of China;In terms of expanding the source of funds,there suggests special aid mode of the Internet platform ways,which is mainly solving the existing issue of insufficient funds.
