On The Practice Reflection And Improvement Of The Quota System Of Legal Officials In Our Country

The official budget system of the French government is limited to the number of judges.It selects outstanding judges with deep theoretical knowledge and rich experience in handling cases from the current selection of judges.It also breaks down the existing management mechanism of judges and manages the classification.The reform of the legal officer system is the premise and foundation of the judicial reform,and it has far-reaching implications for the development of individual judges and the overall work of the people's courts.Since the first batch of pilot projects began in June 2014,until July 3,2017,the constitutional oath-taking ceremony for the first posts of the Supreme People's Court was held in Beijing.At this point,a total of 120,138 judges from various levels of courts across the country entered the amount,marking the full implementation of the reform of the national law officer budget system.The reform of the system of legal officer quotas was not accomplished overnight.At the same time when remarkable achievements were made,many issues worthy of study and reflection also followed.The main issues were:There was no more complete procedural rules for the legal officer system,it was difficult to unify the quota standards,and the number of judges was lost.There are many contradictions between the cases and the people.Judicial reform is a process that is continuously advancing.The flaws in reforms should also be improved during the reforms.Therefore,the author intends to carry out analysis and research on the practice of the reform of China's judicial officer system to provide theoretical and practical perspectives for the reform of China's judicial officer system.This article will be discussed from the following sections:The first part is mainly to systematically explain the connotation of the legal system of officials and analyze the value system of the post system.In the second part,the United States,the United Kingdom,Japan,and Germany are taken as examples to conduct extraterritorial inspections in order to provide experience for the implementation of the post system in China.In the third part,the review and reform of the post reform practice is mainly discussed in terms of the four criteria of the criteria for enrollment,the number of cases,the loss of judges,and the quality of trials.In the fourth part,it explores and perfects the reform of China's judicial officer system.First,we must standardize the quotas;second,we must establish a sound supporting system;again,we must stabilize and improve the judges' team.The fifth part,the concluding part,gives an outlook on the post system and summarizes the content of the article.
