Research On The Follow-up Guarantee System For The Revocation Of Guardianship Of Minors In My Country

When a minor's parents are withdrawn from guardianship,how to find a place for minors.It is very important for the growth and development of minors.China's legal tradition and common people all call the government to shoulder more responsibility in the guardianship of minors.It is the trend of legislation all over the world which state public power is gradually involved in the field of guardianship of minors at present.With the promulgation of the opinions on Several Issues concerning the handling of minors' rights and interests in accordance with the law and the promulgation of the general provisions of the civil law,China's guardianship cancellation system really survived,and the first case of guardianship also be heard.However,the follow-up guarantee is still obviously insufficient.The placement of minors and how to protect the rights and interests of minors after the withdrawal of guardianship,there is no mature legislation mechanism in China at present.This problem has become the research focus of guardianship cancellation system in our country.The opinions and the general provisions of the civil law which have just been adopted in 2017,opened a new starting point for the protection of minors in China.But we need to be conscious of the reality problem is not very well solved.There is still a long way to go to achieve our goals.Guardianship cancellation system needs to be improved.This paper mainly adopts the methods of comparative analysis and empirical analysis.The relative literature about the guardianship system of minors in China and abroad is studied.Take the principle of the maximization of the interests of minors to improve the system of parental guardianship in China.
