An Empirical Study On The Possibilities And Limits Of The Proprietor's Elite Rights Protection Model

With the changes in the national system of property rights,community housing replace units cells and become the main field of dwelling and living.Due to the changes of house ownership,a lot of activism on protecting personal interests and the public interest generated.This thesis selects the protection of JN home communities' rights as a case,through the investigation on activism motives,process and results to observe how the community elites act in the power structure formed by neighborhood committees,owners committees and the property management company.This thesis,based on the theory of community power structure,analyzes the feasibility,validity and limits of “elite rights protection mode”.The first chapter is the preamble.Firstly,it describes origin and meaning and purpose of the study of “elite rights protection mode”;Then,combs thedomestic and foreign research statusof relevant “owners rights protection model”,community power structure and “elite rights protection mode”,community power structure elite research status and rights of models,and presents the value and innovation of my research based on research status.The second chapter is a conceptual analysis.Firstly,it is to make a more detailed definition of the concept about elite and elite community,and summarize the characteristics of elite rights protection mode based on the relevant research;Secondly,to analyze of classic studies of community power structure-elitism and pluralism,which leads to the status of community power structure,to pave the way for the following.The third chapter is to analyze the current situation of community power structure in JN homes and to review the event of its rightsprotection.In this event,the vacancy of JN homes neighborhood committee,highlights the features of the ownerscommittee,but the property management company remains in its propersphere in the whole incident.The protection,from the origin to the last,also go through threestages of rational,irrational and back to rational.This chapter is a detailed descriptionof empirical research.The fourth chapter analyzes the feasibility of elite mode in JN home community.Firstly,it points out the external and internal conditions;Secondly,analyzes how “elite rights protection mode” works at each stage of the whole process.The fifth chapter summarizes the validity of the “elite rights protection m ode”.“Elite rights protection mode” plays different roles at the societal level a nd political level.At social level,it pushes the development of democratic self-government,perfects the pattern of community power structure,and forms the f oundation of civil society;At political level,it perfects the mechanisms of politic al expression and raises the owners' awareness of participation.The sixth chapter is to summarize limits of “elite rights protection mode”.“Elite rights protection mode” has limitations as well,and can lead to negative effects.In view of JN home communities,it causesimbalance of community po wer structure,and thegame among neighborhood committees,owners committee s and the property management company.Secondly,increases free-riding in the process of protection;Finally,it easily lead to unfairness and unsustaina-bilityof communitydemocratizationbecause of its autogenic nature.The seventh chapter is conclusion.Aiming at the problems caused by “elite rights protection mode”,it proposes appropriate countermeasures.I believe that developing community social forces,stably and orderlyimproving and guiding the development of community autonomous organizationand gradually creating a good community environment,are the only ways to realize good governance of basal community.
