Since 2012,digital currency has become a new thing that is active in the currency market.On the one hand,it is technical,practical,and decentralized,which is conducive to innovation in the financial field.On the other hand,it also has its own drawbacks.For example,price instability can easily cause market volatility and make it easy for criminal instruments to participate in money laundering.Activities,impact on the country's original monetary policy,and so on.In this article,the author will take Bitcoin,a typical representative in the field of digital currency,as an example,borrow the coping strategies adopted by national central governments for bitcoin,and the regulatory measures adopted by countries in the legal field against Bitcoin to conduct an in-depth analysis of currency.,digital currency,and the relationship between Bitcoin and their respective legal attributes.At the same time,this article also summarizes the legislative measures that have already been formed in major countries of the world and compares a series of relevant regulations that China introduced after2013 to build a theoretical and practical framework for the future of digital currency regulation and legislation in China.The introductory part will introduce new problems brought about by the advancement of science and technology as well as the objects to be discussed in this article by introducing the general laws of money development.The first chapter introduces the basic concept of digital currency.This section uses Bitcoin as an example to summarize some of the characteristics that differentiate digital currency from traditional legal currency,compare it with other similar concepts,and highlight the advantages of digital currency.The second chapter will focus on its legal attributes.This chapter will clarify the position of digital currency in Chinese law and the various legal risks of digital currency,and clarify that digital currency has a certain legal status and should be protected and regulated by our country's laws as an independent property.Chapter 3 will introduce Bitcoin's impact on the legal currency system of today and its impact on the traditional currency sector.This chapter mainly introduces the reality of Bitcoin's impact on central bank's monetary policy,national credit and tax collection,and the major countries' regulatory measures on Bitcoin.The fourth chapter will answer China's regulatory policy on why Bitcoin adopts a comprehensive ban,and thus finds deficiencies in China's legal system.The conclusion will summarize the full text,re-emphasize the inevitability of the digital currency in the era of the development process and the urgent need for supervision,and strive to improve our digital currency supervision system in an appropriate scope.
