Research On The Procedures Of Public Participation In My Country's Administrative Legislation

With the continuous development of the world economy,the citizen's consciousness of rights and political participation has been promoted,from the direct democracy of ancient Greece to the present representative system,and then to today's participatory democracy.With the rise of participatory democracy and the theory of Democratic administration,Public participation in administrative legislation has been accepted by most countries in the world and become an effective monitoring mechanism for public power implementation.In view of the development of public participation in the administrative legislative process,the law of legislation establishes and develops the principle of public participation in the administrative legislative procedure,and the regulations for the enactment of Administrative regulations and the Regulations for the enactment of regulations elaborate the procedure of public participation in administrative legislation.I think that public participation in the administrative legislative process refers to the government departments in the legislative information in the public premise,the public can actually participate in the administrative legislation in the project,drafting,review and other stages to put forward opinions and opinions,and the government legislative departments to feedback the recommendations of a series of procedures,including information disclosure procedures,Public participation in the administrative legislative process.At home and abroad,the United States,Britain and other countries have established a comprehensive public participation in the administrative legislative process,which ensures that its citizens can actually participate in the process of administrative legislation,so as to effectively monitor and limit the public power.Based on the Constitution of public participation in administrative legislative procedure and the theoretical foundation of public participation in administrative legislation,this paper demonstrates the legitimacy and necessity of public participation in administrative legislation.In combination with the advanced public participation in the administrative legislative procedure,it is proposed that the public participation in the administrative legislative procedure has shortcomings such as the lack of the government information disclosure procedure,the lack of procedure in the stage of administrative legislation,and the imperfect hearing procedure.Although the existing laws and regulations on citizens ' participation have corresponding provisions,the public participation in the administrative legislative procedure lacks the government information public procedure,the absence of the hearing procedure,causes the public to participate in the administrative legislation validity not to embody,the legislation is difficult to embody the public interest appeal,the administrative legislation lacks the scientific,the democracy Therefore,in view of the problems of public participation in the administrative legislative procedure,the author puts forward his own opinion from three aspects,one is to improve and perfect the public procedure of government information,to facilitate the participation of the public,secondly,to establish the administrative legislative motion system,that is,the public can put forward their own legislative proposals in the stage of the project.And through a certain procedure can apply for government projects,and finally the hearing procedures to improve and improve,which mainly includes the perfect participant's representative system and the establishment of hearing information feedback procedures.
