Research On The Principle Of Balance In China's Government Information Disclosure System

Government information disclosure is an inherent requirement of national governance framework and an important way to protect citizens' right to know.The principle of balance is the basic principle and spirit of the Chinese government information disclosure system,which has important guiding significance for improving the government information disclosure system.From the perspective of law,the balance principle includes the balance of right and obligation structure,value structure,interest structure and system structure.Among them,the balance of right and obligation structure is the core to ensure its substantive justice;The balance of value structure guarantees its procedural justice;The balance of interest structure limits the discretion of administrative subject in the process of law enforcement.The balance of institutional structure ensures the realization of the other three structures.The balances of the four aspects run through the whole process of legislation,law enforcement and judicature,from the static level to the dynamic level,from the normative level to the empirical level.The process of government information disclosure is essentially a political process.From the perspective of political science,The balance principle is to control the state administrative power and protect the citizens' right to know as the core,realize the balance between democracy and efficiency in political value,realize the balance between decentralization and centralization in political system,and realize the balance between participation and control in political behavior.This paper takes the balance principle,an important theoretical basis of China's government information disclosure system,as the research object,and according to this principle,puts forward Suggestions for further improvement of China's government information disclosure system.
