A Comparative Study Of International Investment Dispute Settlement Mechanisms

International investment is a powerful driving force for the development of the global economy.International investment dispute is a stumbling block to the rapid development of international investment.The international investment dispute settlement system is the key to solve the international investment dispute and guarantee the stable operation of the international investment order.This paper selects the representative WTO dispute settlement system,the ICSID dispute settlement system,the NAFTA dispute settlement system as the research focus,takes the comparative analysis as the main line,generalizes the three kinds of dispute settlement mechanism procedure rules.This paper summarizes the advantages and existing problems of the three kinds of dispute settlement system,and then analyzes the perfection of the three kinds of dispute settlement system and its enlightenment to China from two angles,aiming at the problems faced by the WTO,ICSID,NAFTA dispute settlement system at present.Some suggestions are put forward to improve the WTO,ICSID dispute settlement system.The enlightenment to China is to perfect the Chinese approach to the dispute settlement system of the WTO,ICSID and to construct the "Belt and Road Initiative" investment dispute settlement system.The final purpose of this paper is to put forward practical suggestions for perfecting the WTO,ICSID,NAFTA dispute settlement system,and at the same time to make suggestions for the construction and improvement of the "Belt and Road Initiative" investment dispute settlement system.
