Research On The Protection Of Intellectual Property Rights Of TV Program Templates

With the vigorous development of the television industry,intellectual property infringement incidents of Television program templates emerge in an endless stream,and it is urgent to protect the intellectual property rights of Television program templates.On the basis of clarifying Television program templates theory and defining the concept of Television program templates,this paper expounds the necessity of protecting the intellectual property rights of Television program templates from three perspectives: reducing the intellectual property disputes of Television program templates,promoting the realization of the commercial value of Television program templates,and promoting the orderly development of the Television industry.And through the method of case analysis and literature research,this paper elaborates the extraterritorial rules and practices of the case law countries and the written law countries in protecting intellectual property of Television program templates,it further explores the protection provided by international copyright conventions and international organizations for the intellectual property rights of Television program templates,points out the dilemma of protecting the intellectual property rights of Television program templates in China.This paper also clarifies Chinese path selection of the protection of intellectual property protection of Television program templates from five aspects: the legislation endows Television program templates copyright,clearing Television program templates infringement standard,improving the registration and filing system for Television program templates,the auxiliary copyright law to protect Television program templates and making full use of the international protection of the Television program templates.
