Research On The Online Arbitration System Of E-commerce Disputes In My Country

Today,with the rapid development of network science and technology,e-commerce has emerged as a new way of trade.He injects a new vitality into the traditional way of life,which greatly facilitates our daily life.At the same time,the problems it brings are unprecedented,and cannot be solved by traditional dispute resolution methods.Therefore,there is a need for a new dispute resolution method to resolve these disputes,so the online dispute resolution mechanism has followed the trend of the times.Online arbitration has the superiority of traditional dispute resolution methods,which can meet the needs of controversial parties well and has great theoretical and practical significance.This paper takes online arbitration as the research object,and combines the traditional arbitration theory to explore the online arbitration system of e-commerce.In addition to the introduction,this article is divided into four parts:The first part is a general narrative of online arbitration of e-commerce disputes.This part is mainly about the basic theory of online arbitration of e-commerce.Including the meaning,characteristics and types of e-commerce and online arbitration,and combining the history to study the emergence and development of e-commerce.The second part is the detailed description of the status quo of online arbitration of e-commerce disputes in China,the problems existing in the practice and the reasons for the occurrence of these problems.This part starts from the practice of our country and shows the whole process of online arbitration and arbitration of Shenzhen International Arbitration Institute.Through the discussion of online arbitration of relatively perfect arbitration institutions in China,we find the specific problems in the practice of online arbitration in China.Further find out the reason for the problem.The third part is the extraterritorial practice and evaluation of online arbitration of e-commerce disputes.This section is based on the online dispute resolution practices of the United States,Cyber Tribunal and the Canadian Online Dispute Resolution Arbitration Center,the International Chamber of Commerce and the World Intellectual Property Organization,and analyzes the advantages and disadvantages of these practices,laying the foundation for the improvement of China's online arbitration system..The fourth part is the perfect proposal for the online arbitration system of e-commerce disputes in China.From the three aspects of perfecting the Arbitration Law of the People'sRepublic of China,improving the network security technology and establishing the promotion mechanism of online arbitration,we propose how to improve the online arbitration system for e-commerce disputes in China.
