With the promotion of mobile communication and wireless network technology,the number of cases using radio information transmission technology as a criminal medium has gradually increased.Some people commit crimes through "pseudo-base stations" and then make huge profits,which has led to the rapid spread of such new crimes throughout the country.However,such crimes are interdisciplinary and multi-disciplinary crimes.They involve a wide range of crimes.At present,the laws and regulations on such crimes are not perfect.There are still many problems and disputes in the qualitative process.Therefore,the use of pseudo-base stations is an act of conduct.Research is necessary.The article takes the case as the entry point and discusses the difficulty in using the "pseudo base station" in the crime identification in practice.It mainly discusses the application of the crime of destroying public telecommunication facilities and disturbing the order of radio communication management,and compares and analyzes the two crimes.In addition,the use of pseudo base stations may also constitute other crimes such as telecommunication fraud crimes.Therefore,the direct use and indirect use of the use of pseudo base stations are described in detail,and the disputes in the process of identification using pseudo base station behavior are discussed.Considering the importance of infringement of legal interests and other factors put forward the author's point of view.
