Research On The International Protection Of Geographical Indications

As international trade increasingly frequent,and the deepening of economic globalization,the United States and the European Union for the pursuit of economic interests in the level of international protection of geographical indication spawned some new move,but the move also reflects two major interests camp about the controversy to enlarge the range of geographical indication protection is still no sign of easing.Based on the actual national conditions of China,it is of great significance to study and analyze the reasons behind the dispute and the rationality of expanding the protection scope of geographical indications.This paper is divided into four parts according to the thinking of raising,analyzing and solving problems.First of all,it introduces the evolution of the concept of geographical indications in different international treaties in different historical periods and interprets the characteristics and value of rights,and introduces the current situation of international protection of geographical indications,which lays a logical foundation for the subsequent discussion.Secondly,the author raises questions,which lead to the disputes between the "new world" and the "old world" about expanding the protection scope of geographical indications caused by different legislative traditions,the ownership of geographical indications resources,agricultural policies and protection concepts.Thirdly,from the perspective of practical protection and interest balance,this paper analyzes the rationality of geographical indication protection expansion,and discusses that the adoption of free trade agreement and multilateral trade agreement can be used as the way of dispute coordination.Finally,based on the deficiencies of China's current protection system of geographical indications,this paper puts forward Suggestions for improving China's protection system of geographical indications,strengthening the protection of geographical indications products,improving the competitiveness of China's geographical products in international trade,and actively striving for the right to speak in the international level of geographical indications protection.
