On The Reason And Prevention Of Extorting A Confession By Torture

Extorting a confession by torture is not only a serious violation of human rights,but also a great challenge to judicial justice and legal authority.Moreover,in both the West and China,the confessions of torture have a long history and have not been completely contained up to this day.There are many reasons for extorting a confession by torture,including the reasons for the legal concept,the reasons for the litigation system,and the reasons for the legislation.Based on the case study,this paper analyzes the characteristics,types and methods of extorting confessions by torture in China,analyzes the causes of extorting confessions by torture,and proposes some countermeasures against the tactics.It must be changed from the legal concept,in terms of procedural law.Continuous improvement,complementing the substantive law.
