On The Criminal Laws And Regulations Of The Theft Of Virtual Property

Theft of virtual property is a major challenge to the order of the virtual world on the Internet.Its high frequency should be paid more attention to and should be included in the scope of criminal law regulation.Virtual property can be divided into account type,item type,general equivalent and virtual property type of currency,etc.,which has both property properties and data properties attribute.Theft of virtual property can be divided into the use of computer information system vulnerabilities,damage to the computer information system,stealing passwords and other ways,it should be included in the system of theft regulation,and there are special theft and fraud behavior on behavior and object difference.At present,there are some problems in China's legislation and judicial,such as unclear concept of property,lack of regulations on virtual property related crimes,unclear identification of the crime of stealing virtual property,lack of value measurement standard of virtual property,insufficient identification of the type of stealing virtual property and so on.On the basis of drawing lessons from practices outside the region,China's current criminal law against the theft of virtual property on the problems of legislative and judicial,should be separated from aspects on making amendments to the criminal law,legislation,legislative interpretation,formulate special laws of protection of virtual property and the judicial set clear virtual property value method,publish guidance case,set clear stealing virtual property behavior type,set clear standard of the measurement of penalty and case determination carries on the solution.
