Research On The Knotty Issues Of Bribery Crime

With the continuous improvement of the anti-corruption system,the supervision committee came into being,which triggered a heated discussion on bribery crime in the theoretical circle of criminal law.The rationality of the scope of bribery,the influence of the "People's Republic of China Supervision Law" on the scope of the main body of bribery and the criminal law system of atypical bribery are all the problems bribery that are often discussed in the theoretical circle and difficult to break through in judicial practice.The establishment of the supervisory authority will take over the investigative powers originally belonging to the procuratorial organs for accepting bribes.The scope of supervision under the Supervision Law is quite different from that of the subject of bribery.Based on the issue of the scope of accepting bribes and the issue of atypical bribery,this paper studies the influence of the Supervision Law on the scope of bribery subjects.According to the theory of bribery crimes,this paper proposes to include non-property interests other than sexual bribery in the scope of bribery.It is recommended that the existing bribery subject should not be replaced by “national public officials”,and the crime of accepting bribes should be used to regulate the atypical bribery behavior such as option bribery and emotional investment bribery.
