Research On The Punitive Damages System In The Food Safety Law

Although the punitive damages system is foreign foods,it has been rooted in the fertile soil of practice in China.The revised Food Safety Law in 2015 revised the provisions of punitive damages and made some breakthroughs,making it the most stringent application system in the application of punitive damages system.Punitive damages have particularity in the field of food safety.The purpose of legislation is to severely punish vicious producers and sellers in the field of food safety,effectively safeguard the legitimate rights and interests of consumers,and improve the situation of disrupting the food market economy.However,there are still some disputes in judicial practice that need to be solved urgently.This paper examines the deficiencies of the punitive damages system in China's Food Safety Law.This article mainly for correcting the provisions of the court interpretation of the High Law of "Knowing False and Buying Fake",subjective to operator to the clear and definite stipulations of the "knowing",rationally stipulate applicable standards that do not meet food safety standards,improving and perfect the mechanism of punitive damages,the consumers of evidential proof difficult problem of effective suggestions.It is expected that the punitive damages system in the Food Safety Law can be further improved through the above practical and reasonable suggestions.More effectively play its role of punishment and deterrence,promote the health and stability of the food competition market,and then create a comfortable and secure food safety trading environment for consumers.
