Living will,as a legal system to comply with patients' medical will,has attracted much attention in developed countries and has been recognized by the legislation of most countries in the world.However,China is currently in the stage of practical exploration of living wills.The research on living wills started late,and the living will system has not been established yet.Therefore,we need to do sufficient theoretical research before legislation.This paper takes the legal regulation of living wills in China as the object of study.Firstly,it differentiates the concept of living wills and other related concepts,and then introduces the development of living wills system in typical countries and regions to explore the legislative reference of living wills in China.Secondly,it briefly reviews the legislative and social status quo of China,and comprehensively analyzes the legislative dilemma of living wills in China.In the end,this paper focuses on the analysis of the legislative motivation of living wills in China,and makes a preliminary exploration of the legislative conception of living wills in China from three aspects including core legislative ideas,legislative mode selection and specific legislative contents by comparing and referring to the legislative experience of other countries and combining with China's national conditions,so as to put forward preliminary Suggestions for the legal regulation of living wills in China.
