The Criminal Law Amendment(IX) has taken a huge step in the fight against terrorist crimes.The addition of many crimes related to terrorism has made the criminal law network more perfect.But there are many problems about the crime of illegal possession of promoting terrorism and extremist in judicial practice.This article summarizes the serious problems that arise in judicial practice.If the country unrestrainedly suppresses the free space for the people,the uneasiness and fear of the people will be superimposed.It is because they must be wary of the dangers from society,at the same time,they must be alert to the government’s misconduct.Therefore,the state must protect the free space of the people and become a "guardian" rather than an Intruder.With the basic position above,the first three chapters of this article are an interpretation of the elements of the crime.The second chapter mainly discusses the criminal objects involved in this crime,namely,the audio,video,books and materials that promoting terrorism and extremism.They are different from the objects of traditional crimes.For the illegal possession behavior,it is a factual dominance state,which has different holding forms for different item forms.The third chapter mainly explains the subjective responsibility elements.At the same time,it must be emphasized that this crime must require specific purposes in terms of the subjective responsibility of the actor.This is the key point for the protection of civil liberties.
