Study On The Procedures For Monitoring The Retention Measures

Since the reform of supervision system was piloted in three provinces and cities in 2016.remarkable achievements have been made after two years of hard construction.A four-level supervision system has been set up in the whole country,which includes the National Supervision Committee,the Provincial Supervision Committee,the Municipal Supervision Committee and the County Supervision Committee.The supervision of public officials has reached an all-round coverage.The anti-corruption mechanism has been brought into the track of the rule of law,stepping into a standardized and long-term mechanism.The newly issued"Supervision Law of the People's Republic of China" gives the supervisory committee 12 statutory powers.As the most stringent measure,"retention" has been widely disputed by the society.However,the "retention" measure is an indispensable means to achieve the purpose of the supervision law.the legitimacy of the retention measure directly affects the legitimacy of the implementation of the entire supervision law.The severity of detention measures is procedure of detention measures is simpler.Only by standardizing its implementation in procedure can we achieve unity and balance in protecting the rights and interests of the relative person and realizing the purpose of the supervision law.clarify the legal significance of the procedure and the procedure norm of detention measures,and then make a comparative analysis and discussion on the contents of the procedure of detention measures,so as to draw the defects in the procedure norm of detention measures in the supervision law,and put forward some ideas of optimization of the procedure.
