Modern justice comes from the discussion of the gap between the rich and the poor.To solve this problem,John Rawls,a professor at Harvard University,published his Theory of Justice in 1971.As the pioneer of contemporary political philosophy,Rawls regards justice as the center of his inquiry.In his theory of justice,he discusses the equal rights and the rights that justice should guarantee.Rawls put forward the solution of rights through social contract,and the topic of justice has become a hot topic.In response to this,there has been an upsurge in foreign countries to discuss whether Marx has the idea of justice.The author agrees with Marx's view that justice exists.Marx is critical of legal power and ideology.Therefore,he disagrees with the solution of Rawls' s rights from the Marxist standpoint.The justice discussed by Rawls is only an abstract construction,which can not really solve the problem of poverty.The equity and justice discussed by Marx can help solve the problem of poverty.On the one hand,Marxist philosophy is critical,and the historical materialism created by Marx can provide scientific world outlook and methodological guidance for the analysis and interpretation of social justice issues;on the other hand,his justice thought takes history as the research perspective and applies scientific theory,and at the same time has concern for reality,so standing on the Marxist standpoint,Rawls' s theory of justice can be reasonably criticized and transcended,so as to provide a correct way to solve the problem of justice.Because Rawls is the representative of neo-liberalism,the transcendence of Marxism over Rawls actually means the transcendence of Marxism over liberalism.Justice is also of great practical significance in China.On the one hand,poverty and unfair social distribution are still prominent in China.Common prosperity needs to be realized urgently.By responding to Rawls from the Marxist standpoint,we can further highlight the value of Marx's justice thought in the times and further consolidate the theoretical guiding position of Marxism.On the other hand,our country is in the primary stage of socialism,while vigorously developing the productive forces,we should also pay attention to the protection of civil rights,so it is necessary to fully affirm the reasonable content of Rawls' s justice thought.Starting from the solution of poverty,this paper discusses the solutions of Rawls and Marx,in which Rawls is the solution of rights and Marx is the solution of non-rights.On the basis of a comprehensive review of the two solutions,we should highlight the profundity and Transcendence of Marxism.This paper can be divided into five parts as follows:The first part is the introduction,which mainly outlines the research background,explains the reasons for the problem of the modern justice,and comprehensively discusses the current research situation.At the same time,it clarifies the significance and purpose of the study,clarifies the research ideas and puts forward the innovations of this study.The second part discusses the solution of Rawls' s rights.Rawls gives the right solution to poverty from the perspective of social contract.This paper mainly discusses the theoretical basis and institutional support of Rawls' s justice thought,and comprehensively examines his solution of rights.The third part is from the Marxist standpoint,aiming at Rawls' s solution to rights,launching a detailed criticism of legal rights,ideology and wages,which shows the Marxist historical materialism standpoint.The fourth part elaborates Marx's non-right solution.Marx took the economic basis as the starting point,paid attention to the problems of real production and life,and opposed the principle of formal justice.On this basis,in order to solve the problem of poverty of the proletariat,Marx further envisaged the solution of communism and scientific socialism.The fifth part evaluates Marx's theory of social justice,fully demonstrates the historical position of Marx's theory of social justice,affirms Marx's solution,absorbs the merits of Rawls' s solution,and provides theoretical reference for promoting fairness and justice in the new era.
