Research On The Acceptance Of Cases By Public Security Organs In Our Country

With the rapid development of China's economy and culture and the continuous advancement of the rule of law,Chinese people's awareness of the rule of law has been further enhanced,and therefore the public has higher expectations and requirements for the law enforcement of public security agencies.Among the hot issues that the public is concerned about,the issues of case acceptance and case filing after the case report are relatively sensitive as well as challenges faced by law enforcement.This thesis focuses on the practical problems and difficulties faced by the public security agencies on case acceptance and case filing and sorts out such three core problems as weak legal basis of case acceptance and case filing,law enforcement management defects,and public demands beyond legal norms.This thesis deeply analyzes the typical situations covered by these three problems and their causes and harms,explores the functional value of the related legal norms and puts forward solutions.The solutions include the legitimate operating mechanism of case acceptance and case filing to establish the rules and standards for the evidence,adoption of multi-factor consideration for the rules and the establishment of legal duties exemption system,further improvement of oversight mechanisms and laws and regulations of case acceptance and case filing,creation of transfer and linkage channels between 110 emergency call center and other departments towards public demands beyond legal norms to further clarify the jurisdiction of public security agencies,improve the legislation of help function,and reasonably expand relevant authorities.The most fundamental value pursuit of this thesis is,from the perspectives of the support of legal system to the law enforcement,the guidance of law enforcement norms on practical work,and the functions of government in social governance,the endeavor to establish a more complete legal procedure for case acceptance and case filing,more effective law enforcement supervision and more optimized service mechanism to further improve the quality of public security law enforcement,protect the legitimate rights and interests of the people more scientifically and effectively,and enhance the public sense of satisfaction with the rule of law through the law enforcement activities of public security agencies.
