Research On The Welfare Administration Of Domestic Violent Children

With the increasing pressure of social life and the increase of family centrifugal force,it is common for family members to commit domestic violence against children.At the same time,influenced by Chinese traditional culture,the administrative organs and the relevant departments rarely pay attention to contradictions among family,generally following the principle of "not to ignore".As a result these abused children by domestic violence are often seriously injured or dead,which not only causes serious physical harm to children,but also leaves the psychological trauma which is difficult to heal.Under the guidance of the theory of state parental power,family parental power is invalid,and the state has the vicarious obligation.Among them,the administrative protection in the state protection is the most effective way.In addition,with the construction of service-oriented government,the government should not only assume the responsibility to protect the survival of children,but also to promote the development of children,that is,to protect children by means of welfare administration with the concept of "child development".The protection of abused children is a fundamental part of the child welfare administration.The government's responsibility for children is the core of the child welfare system,which not only includes the system design and procedure processing for individual cases,but also includes the guarantee of universal benefits.Therefore,administrative organs are required to intervene in the family abuse of children in a timely and effective manner in accordance with the laws and regulations,and take the principles of "the best interests of children" and "child development" into consideration.However,at present,child abuse is often reported in China,and children are either killed or seriously injured.Child welfare administration is a dynamic process of mobilizing resources to protect child welfare under the guidance of law.Therefore,from the legislative and practical aspects,the first chapter of this paper analyze our welfare administration of abused children,to find out the existing problems and reasons.The administrative problems of the welfare of abused children in our country mainly include not timely assistance,inadequate measures to settle asylum,and insufficient measures to prevent domestic violence.The reasons are that the welfare of children is not taken seriously,the identification standards of "child abuse" are not consistent,the reporting and asylum system is not perfect,and there is a lack of specialized and efficient administrative institutions for child welfare."Child abuse" is a global problem with common characteristics in different countries or regions.As a typical welfare state,the United States and Japan have also gone through a long exploration of administrative protection of domestic abuse children,including system design and specific practice.In the second chapter,the author tries to improve the welfare administration of domestic violence and child abuse in China by examining the similarities between the United States and Japan.Among them,the most important task of the child welfare policy of the United States is to protect the abused children.It has achieved the legislative protection of the abused children through the mode of individual law and promulgated the child abuse prevention and treatment act.Each state government has set up the children's bureau,under which the child abuse and neglect office is responsible for child abuse cases.Under the guidance of the federal government,the state government has timely and effectively intervened in the families of abused children and formulated complete resettlement measures.With a focus on child abuse prevention,the federal and state governments have launched a series of support and help programs for families.The legislative protection of abused children,specialized administrative organs,complete resettlement measures and advanced concepts of child protection in the United States are worth learning from in China.Japan,like the United States,has a fairly complete legislation on child protection and welfare,and has promulgated the law on the prevention and treatment of child abuse and the law on the welfare of children.A children's consultation center with professional skills has been set up,and the children's consultation center is equipped with professional qualified rescue personnel,At present,Japan's child protection agencies and personnel are developing towards a more professional and efficient direction.In Taiwan,China has promulgated the child welfare law and the law on the protection of the rights and interests of children and juveniles,and established the children's bureau of the ministry of the interior.As a result,the third chapter basically write that our country need to improve in the legislation and practice two aspects.As to legislation,our country needs to be issued for child abuse protection law and the top design of children's welfare law,or modify the existing "minors protection law" and "anti-family violence law" in the part of child abuse in order to better protect children's welfare.In practice,it is necessary to establish competent authorities or enforcement agencies to protect child maltreatment,increase the scope of obligatory reporting agents,improve resettlement measures,and strengthen the introduction of support and assistance programs for families.
