The Dilemma And Improvement Of The Connection Between Administrative Law Enforcement And Criminal Justice

The convergence between administrative enforcement and criminal justice is also called Mthe Convergence of two methods" or "the Convergence of execution".At present,it is one of the important tasks to speed up the construction of socialist political civilization in China.However,according to the problems in the current practical work,there are many obstacles and problems in the practice.From the point of public security authorities,this paper will discuss the dilemma and improvements of the Convergence of two methods in three chapters and several issues.The three chapters mainly discuss the inevitability of the Convergence of two methods;the achievements and difficulties of the Convergence of two methods;and the perfection of the Convergence of two methods.The three chapters elaborate the theme from different perspectives,such as theoretical framework,realistic dilemma and case analysis,and finally,draw the conclusion for it.From the perspective of public security authorities,the Convergence of the two methods is not only the simple submission of evidence but also the re-characterization and investigation of cases.If there is a mistake in the Convergence due to the cooperation of the departments in the work,it will probably result in the absence of the elements of the case,which will lead to the serious consequences of the impunity of the offenders or the wrongdoing of innocent citizens,so we have to increase vigilance and energy investment.But doing so will increase the work intensity of basic level police,make the limited police force more decentralized,but not conducive to the effective operation of social management functions.Therefore,we need to seriously re-discuss the Convergence of two methods from the perspective of public security authorities.The inevitability of the Convergence of the two methods is not only a historical trend in society,but also a practical requirement of practical work.Under this premise,many scholars have made outstanding contributions in this field,mainly in the economic,environmental and public affairs management,the opinions and suggestions emerge endlessly,but there is no systematic theoretical combing and literature review to guide practical work.Therefore,based on the previous research,this paper summarizes the various tactful operation methods and gives some opinions.,it expects to be able to provide a small force for the actual production and life needs.Because of the late start of the research in the field of the Convergence of two methods and the immature theoretical framework,there must be such a part that does not meet the needs of social reality,but the development of things is bound to continue to move forward in difficulties and failures,as is the pace of the construction of the rule of law in our country.Only through various difficulties and setbacks can we really find the practical operation that meets the needs of the socialist rule of law in our country.Imperfect legislation,ineffective mechanism and lack of supervision are the main reasons for the dilemma of the Convergence of two methods.From the point of public security authorities,it also includes the Department competition between administrative authorities and public security authorities,as well as the preservation and transfer of evidence and many other aspects of competition,the overall need for improvement is quite a lot,in order to make the Convergence of two methods show remarkable results,it is not a day's work.Therefore,more people with lofty ideals are needed to constantly enrich the theories,construct mechanisms and strengthen supervision so as to eliminate the barrier of departmental cooperation,simplify administrative procedures and improve work efficiency so as to finally meet the requirements of building socialist political civilization.In a word,on the basis of literature review and comparative study,this paper analyses and summarizes the theories of various countries,and finally draws some superficial opinions,hoping to have a positive and positive impact on some problems in the process of linking administrative law enforcement with criminal justice.
