| Administrative enforcement in the field of urban management is at the intersection of public power and private rights,which often leads to friction and confrontation between the administrative subject and private party.However,traditional external power regulation mostly bases its arguments on the wickedness of administrative power,and then puts the administrative subject and private party in the state of eternal conflicts.It is really unable to solve all kinds of problems in the process of urban development.The self-control system of administrative enforcement takes the theory of executive process as the basic point of view,the theory of administrative self-restraint as the core principle,and the theory of power control as the connection between internal and external restriction,thus providing a new cohesive scheme for the power restriction.This mode of administrative internal control has many unique advantages,such as multi-level domains in scope,autonomy in driving,full coverage in nodes,etc.It is not only an important driving force to promote local government to innovate and rule of law,but also a key to maintain the harmony of urban life.However,from the perspective of practice,there are many problems in the operation of this self-control system,which are mainly manifested in four aspects: the misunderstanding of discretion standards,failure of flexible law enforcement,poor feedback of administrative performance evaluation and ineffectiveness of ethical training.Therefore,the perfection of the self-control system must rely on the internal administrative law,and take three objectives--administration with goodness,keeping urban order and innovation of social governance as the goal guide of system construction.Meanwhile,we need to set moderately scientific discretion standards and regulate the flexible law enforcement.Moreover,the administrative performance evaluation system and the ethical rules about city management should be improved. |
