On The Legal Regulation Of Pyramid Schemes

Since the 1990s,pyramid selling has been introduced into China,and it has become a persistent disease in the economic and social development China's laws have gone through a gradual process of perfecting its regulations.With the development of economy and society,pyramid selling has been changing its patterns and forms to evade the law and regulations,deceiving people who do not know the truth.At present,MLM is developing faster and more dangerous with the help of Internet conditions.Relevant laws on pyramid marketing regulation is not in place,to a certain extent,aggravated the harm of pyramid marketing.This paper analyzes the current status and problems of the law on pyramid marketing regulation,and gives some suggestions to improve the relevant laws.This article is divided into four parts.The first part is ontology,that is,an overview of pyramid schemes.This paper expounds the origin and development of direct selling abroad,the development and variation of direct selling in China,and analyzes the main manifestations of pyramid selling in China at present.The second part is the theory of history.It expounds the course of legal regulation of pyramid selling in our country.From strict management,complete prohibition to gradually establishing and perfecting a scientific and reasonable legal regulation system,our anti-pyramid selling legislation has gone through a road in line with the national conditions of China,safeguarded the safe development of economy and society,and guaranteed people's lives.Produce life.With the development of the rule of law,its problems are increasingly prominent and need to be forther improved and perfected.The third part is the epistemology of legislation and law enforcement.From the perspective of legal regulation,this paper analyzes the current situation and problems of anti-pyramid selling in China.It also analyzes the present situation and problems of anti-pyramid selling from three aspects:criminal legislation,administrative legislation and law enforcement,civil law.Among them,the analysis of criminal legislation is the main part.The innovation of this part is to sort out the shortcomings of the legal provisions in a more comprehensive way.The legislative concepts and specific provisions are involved in both aspects.It is not only limited to the analysis of criminal legislation and judicial practice,but also analyzes the shortcomings of civil legislation.The fourth part can be called methodology.In view of the problems in the third part,the author gives some thoughts and suggestions on perfecting the legal regulation of pyramid selling.Anti-pyramid selling needs to establish a comprehensive and perfect legal system,not a certain aspect of the law can be completed alone.Among them,the improvement of civil law can better reflect the concept of modern rule of law to protect the private rights of citizens,it must be gradually reflected in the relevant legislation in the future,will make up for the priority of public law in China's governance status and phase.This is also the innovation of this part.
