Research On The Legal Issues Of Life Insurance Trusts

Life insurance trust is a new type of financial product and an effective integration of life insurance and trust system.Its advantages are low investment risk,diversified investment choices,and broadening the business channels of financial institutions.The theoretical research of life insurance trust in China is still a relatively new field.The establishment of the legal system is at a blank stage.Moreover,there is no comprehensive and clear concept of the meaning of life insurance trust in China.However,in many advanced countries such as the United States and Japan,their legal system has reached a relatively complete level,and in practice there are many valuable references.But also because life insurance trust is a new thing,it is not perfect in law and system,and there are still some risks.Because of the immature development of China's economic development level and life insurance trust,there are still big differences with the United States,Japan and other countries.This paper draws lessons from the developed countries' life insurance trust legal system and actual development model,but also meets the needs of China's economic and social development.Therefore,this paper discusses the legal issues of life insurance trust in China from four aspects.The first part is about the general theory of life insurance trust,mainly discussing the concept and function of life insurance trust,and on this basis,discussing the current situation of life insurance trust in China.The second part mainly analyses the existing legal problems of life insurance trust in China from the legal subject,supervision and tax status.The third part draws lessons from foreign life insurance trust legal system and enlightenment.The author uses the comparative research method to analyze the life insurance trust legal systems of the United States,Britain and Singapore,analyze their business model and supervision system,and combine them with the economic development phenomenon of our country,in order to explore the development model of life insurance system in our country.The fourth part studies the legal issues related to life insurance trust,analyses the problems existing in the law of life insurance trust and puts forward solutions to improve the legal system of life insurance trust in China.
