This paper takes the identification standard of labor relations in China as the research object.The problems faced by the labor relations identification standards in China since the implementation of the "Labor Law" are the starting point of the research,using the case analysis method and the comparative research method to determine the standard of labor relations in China.Conduct analytical studies.The research in this paper mainly includes the following four parts:The first part is an overview of the basic theory of labor relations identification standards.By discussing the connotation of labor relations,the connection and distinction between labor relations and other similar legal relationships(labor relations,employment relations),and the general theory of labor relations identification standards,the importance of the labor relations identification standards in China is highlighted.The second part is the status quo and problems faced by China's labor relations identification standards.After analyzing the theoretical viewpoints and practical problems of China's labor relations identification standards,it is pointed out that China's current labor relationship identification standards are subject to the definition of laborer and employer's subject qualifications,the labor relationship's personal attributes and economic attributes are weakened,and the labor relations between the subjects Part of the rights and obligations,and the lack of legal protection of non-standard labor relations.The third part is the analysis of the reasons for the problem of the identification of labor relations in China.Including the stipulations of labor relations certification standards,the differences in the application of labor relations certification standards and the emergence of new diversified employment forms.The fourth part is to think about perfecting the standard of labor relations.This part mainly proposes the improvement of the labor relationship identification standard for the existing problems of the second part and the third part of China's labor relationship identification standard.This part mainly clarifies the main connotation of labor relations,constructs new labor relationship identification standards and emphasizes the right These three aspects of the protection of standard labor relations put forward relevant suggestions for the improvement of China's labor relations identification standards.
