The implementation of Labor Contract Law has ended a long-time situation of non-law for labor dispatch, and together with Labor Dispute Negotiation and Arbitration Law, which have provided strong protection for dispatched employees, regulates employment behaviors for dispatch organization and employing unit, which has profound meaning to the establishment and development of a stable employment relationship.There have already been lots of papers on labor dispatch, the most of which are mainly from a very height of theoretical system research, while it takes a long time for every system to be imagined to be realized and couldn?t solve the problems in current labor dispatch in a short time, especially for problems arisen from the application of labor dispatch policies. This paper focuses on the research of the labor dispatch in China, through analysis of the problems arisen from the application of labor dispatch policies, put out some of my tentative opinions on how to solve the current problems so as to further improve relevant labor dispatch policies.The first chapter ?guidelines of labor dispatch? firstly outlines the origination, development and definition of labor dispatch world wide. Secondly it introduces the current legislation situation of labor dispatch as well as the history background and development reason in China. The second chapter ?the specialties of China labor dispatch?introduces the legal relationships among three parties in labor dispatch, then based on the current cooperation mode between the dispatch organization and the employing unit to further introduce the specialties of labor dispatch. In addition, it also analyzes the same and difference aspects between traditional human resource services such as recruiting and work contracting.The third chapter ?problems in current labor dispatch in China? analyzes the problems in current labor dispatch from the following three aspects together relevant working experiences in dealing with disputes related to labor disputes: the return of the dispatched employee, the probation period for labor dispatch, the liabilities between dispatch organization and employing unit.The forth chapter ?suggestions for improving labor dispatch in China? put our some opinions and suggestions to the current problems in labor dispatch from the aspect of the access to labor dispatch market, regulating the labor dispatch agreement and further improving relevant labor dispatch policies based on several years of experiences in dealing with relevant disputes and the legislation spirit of labor law and labor dispatch policies.
