On March 31,2005,the United Nations Security Council(UNSC)adopted resolution 1593 to refer the situation in Darfur since 1 July 2002 to the Prosecutor of the International Criminal Court(ICC).It's the first time that the Security Council to exercise the right of submission and Sudanese president Omar Al-Bashir is the first current head of state of being wanted and prosecuted by the ICC.In this paper,the author wants to take the Sudan's Darfur situation as the background,the first two parts through specific case discuss the jurisdiction of the ICC,the third part,through the discussion of specific case,analyze our country's attitude towards the ICC's related issues and make a prospect for the future.through the comparative research,literature research and the method of historical research thesis research methods,try to analysis to explore the ICC in Sudan's Darfur situation involved in the international legal issues,and China's attitude and choice.In addition,the paper also believes that it is necessary to reform the forms of international criminal judicial system which require the participation of China,but such a process is a double-edged sword for China,we should take it seriously.
