On The Legal Status And Application Of The Employment Assistance System

Maritime savage regulations is a unique legal regulation of maritime law,and many countries try to adopt international treaty into their domestic law for the development of international salvage.In our country,controversy still exists on whether engaged salvage belongs to maritime salvage in Chinese academy.This thesis researches on this topic from its legal status and application of law,to exploit the legal attribution of engaged salvage problem.The first part illustrates the legal status of engaged salvage.Compared conception,constituent elements,and characteristics in engaged salvage with maritime salvage,it can be determined that engaged salvage belongs to maritime according to the purpose of maritime salvage.In contrary,it can be found the relationship between engaged salvage and maritime salvage,and proved the opposition and unity between engaged salvage and conventional “no cure,no pay” form of maritime salvage.Through these analysis,the initial conclusion of whether engaged salvage belonging maritime salvage can be determined.The second part illustrates the application of law in engaged salvage regulation.According to the explanation of International Convention on Salvage,1989 in the meaning of text,system,history and the thinking of entirety and logicality,the final conclusion of the relationship between engaged salvage and maritime salvage can be summarized.Furthermore,it can demonstrate the detail application of engaged salvage of law and try to explain the essential meaning of related legal provisions.Through the analysis of whether engaged salvage suitable for other maritime law,it can be concluded the legal status and applications of engaged salvage combined with first part.The third part illustrates the suggestions and composition of engaged salvage.Because the confused conception of engaged salvage in our country,it is significant to introduce engaged salvage regulation into maritime law when it is mature,according to the engaged regulation in maritime law.From this measure,the legal status of engaged salvage can be clear.At the mean while,it is required to design legal provisions for application of engaged salvage.Combined with International Convention on Salvage,1989,it can be revised carefully for maritime law.
