Research On The US Carbon Tariff System And China's Response In The Context Of Carbon Emission Reduction

The global climate problem has attracted more and more attention due to the emission of greenhouse gases.Many countries have taken measures to carry out various forms of international cooperation in order to solve the problem of climate change.Among them,the contradiction between environmental protection and economic development is becoming more and more prominent.In order to protect domestic trade,European and American countries take different forms of "carbon tariff" measures.In this context,the number of countries in the European and American countries in the name of "carbon leakage in the country",carbon-intensive products,including China,which do not take carbon-reducing measures,are subject to various forms of carbon tariffs.According to international official data,as the largest exporter of goods and services in the world,most of the export products are products of carbon tariffs imposed by European and American countries,and Europe and the United States are the main export markets for the actual situation of our country carbon-intensive products.Thus,it can be seen that If developed countries,such as Europe and the United States,impose large-scale carbon tariffs on our products,then the impact of carbon tariff policies on the actual situation of our country economic development will be enormous,which will also hinder the overall economic development of our country,and the volume of our trade and exports will decline sharply.And the actual situation of our country recover for a long time.Therefore,only by clarifying the impact of the carbon tariff system on our country and taking the initiative to take carbon emission reduction measures can China reduce the impact of the carbon tariff system on the economic development of the developed countries represented by the United States.As a big trading country in the world,the legal policy of environmental trade in the United States has a great influence on China.Therefore,it is of great practical significance to study the carbon tariff system in the United States.Taking the United States as an example,this paper analyzes the impact of carbontariff imposed by the United States under the background of carbon emission reduction and the countermeasures of China.First,this paper expounds the general theoretical issues of carbon tariff.First of all,this paper discusses the related concepts and theoretical basis of carbon tariff.Secondly,through the analysis of the background and causes of carbon tariffs in various countries,the meaning,nature and characteristics of carbon tariffs are clearly defined,and the carbon tariffs are analyzed and defined in detail.In this paper,the main contents of American carbon tariff are summarized and analyzed.First of all,the legislation of carbon tariffs in the United States has been analyse,mainly by the Lieberman-Werner Act of 2008 and the United States Clean Energy and Safety Act,for example,in 2008,the Lieberman-Werner Act,The different regulations of domestic producers and importers are compared,and the scope and obligations of domestic producers are analyzed.For importers,three parts of the inventory,inventory and international quota indicators were analyse.<The US Clean Energy and Safety Act> can be summarized as a carbon emission total control system,an international reserve quota plan and a quota return plan.In addition,the international reserve quota plan discusses the conditions for the approval of the Congress,the main content of the system,and the possibility of the United States to build an international quota reserve plan,respectively.In addition,based on the overview of the two US carbon tariff acts,this paper analyzes the legality of the US carbon tariff.At present,the legality of carbon tariffs in the international community is still controversial.In view of this,this paper analyzes the carbon tariff of the United States according to the relevant regulations of WTO.The first is the general exception clause of carbon tariff and environment,the second is carbon tariff and national treatment,the principle of most-favoured-nation treatment and the principle of abolishing quantitative limitation.Finally,the carbon tariff and common but differentiated responsibilities are discussed.Third,this part of the article analyzes the impact of the US carbon tariff system on China.In this paper,we first analyze whether the US carbon tariff will affect the economic development of China from the perspective of the comparability ofinventory countries,listed products and carbon abatement measures.Then this paper analyzes the impact of American carbon tariff system on China from three angles.Fourth,the last part of this paper puts forward the measures China should take to deal with the US carbon tariff.This paper analyzes the possibility of introducing carbon tariff measures in the United States,in the light of the actual situation of our country,under the background of ecological civilization construction,it is divided into two main bodies,enterprise and country,from two levels,international and domestic,respectively.This paper puts forward some suggestions on how to deal with the threat of American carbon tariff system.
