Research On The Legal Issues Of The PPP Model For Soil Pollution Remediation

Due to severe soil pollution,complicated reasons for pollution,various pollution types and difficulty in identifying the main responsibility for pollution in China,there are a lot of problems such as insufficient funds for polluted soil remediation and high difficulty in polluted soil remediation.Thus,the polluted soil remediation is characterized by large investment,long period and high difficulty,etc.Especially,while soil pollution is caused,there is atmospheric and water pollution caused in the surrounding areas.Compared to the pollution of other types,polluted soil remediation is of higher difficulty,for there are several reasons.On one hand,there is a great variety of toxic and harmful substances in the polluted soil and it is hard to eliminate them,and there are high requirements for technology and lot of funds should be needed.On the other hand,the atmospheric and water pollution in the same area can cause soil pollution,so mechanical soil remediation is unavailing.In consequence,comprehensive remediation should be implemented to cope with the atmospheric and water pollution,which is the reason for the soil pollution.Under such situation,it's been the inevitable trend to solve the problems about soil pollution and market failure of soil pollution control,mitigate the contradictions between insufficient financial investment and financial gap of soil pollution control,improve pollution control effect and reduce pollution control risk.PPP market “failure” due to many reasons at the present manifests there are many problems for which soil remediation PPP model is applicable for.However,it doesn't mean that it is not correct that soil remediation is applicable for PPP model.Therefore,based on the analysis and study on soil pollution control and according to the specific situation of introducing PPP model into the soil pollution control in China,many legal problems including system construction path of soil pollution control PPP project in China are analyzed and discussed from many perspectives such as the significance and advantage of introducing PPP model to the soil pollution control project,and development situation and system status of soil pollution PPPproject in China so as that China's soil pollution control PPP model could be improved and developed to a certain extent.
