Research On The Appeal Mechanism Of International Investment Arbitration From The Perspective Of "One Belt One Road"

With the advancement of globalization,economic exchanges among countries in the field of investment have become increasingly close,and international investment arbitration mechanism has attracted more attention.The traditional rules of international investment arbitration mechanism are based on the rules of international commercial arbitration mechanism.In fact,the nature of international investment is different from that of international business,and the rules of international commercial arbitration can not be fully applied to the rules of international investment arbitration.In recent years,the drawbacks of the traditional international investment arbitration rules have become more and more obvious,and the voice of countries for the reform of the international investment arbitration rules has become increasingly fierce.The purpose of this paper is to study and analyze the shortcomings of the traditional international investment arbitration mechanism and explore the establishment of an appeal mechanism for international investment arbitration.Based on the above background,this paper demonstrates the establishment of the appeal mechanism of international investment arbitration from two aspects.On the one hand,by analyzing the shortcomings of the traditional international investment arbitration mechanism,this paper analyses the impact of the appeal mechanism of international investment arbitration on its defects;on the other hand,by analyzing the possibility of establishing the appeal mechanism of international investment arbitration and designing it from the institutional level,it provides sufficient theoretical support for the establishment of the appeal mechanism.In practice,by analyzing and studying the exploration and practice of appeal mechanism in various countries,the author summarizes the experience,summarizes the advantages and disadvantages,and then points out the direction for our country to choose the mode of appeal mechanism.To sum up,this paper makes a comprehensive analysis of arbitration mechanism in international investment through induction and comparison,and on this basis,demonstrates different modes of appeal mechanism in practice,so as to choose the mode of appeal mechanism suitable for our national conditions.
