Research On The Adult Guardianship System

The adult guardianship system in China is an important civil legal system that mainly depends on the gradual development of the guardianship system for the elder.This system is not only an important measure to deal with an aging society,but also a key measure to maintain social stability and promote harmonious development.With the development of the adult guardianship system reflects the humanistic spirit of protecting human rights and protecting the rights and interests of the weak,The promulgation and implementation of China's "General Principles of Civil Law" has officially opened a new chapter in China's adult guardianship system,"General Principles of Civil Law"has made major amendments and innovations to the legal person content of the adult guardianship system in China.The main ones are the clarification of the guardianship system,the expansion of the scope of the guardianship system,and the formal establishment of the legal status of the adult guardianship system.These Regulations are all new and commendable.However,the legal provisions have not yet achieved perfect results,and there are still some deficiencies and loopholes in the current system regulations.So,this article will analyze the related issues of the adult guardianship system,hoping to find effective solutions to the problems in the current legislation.In addition to the introduction,there are four main parts in the paper.The first part mainly introduces the basic theory of adult guardianship.It analyzes and compares the related systems of adult guardianship from the concept,discusses the nature of adult guardianship system,and explain the main value functions of the adult guardianship system in combination with actual situation;the second part mainly introduces the innovations and breakthroughs of China's adult guardianship system after the promulgation of the General Principles of the Civil Law.While affirming the great promotion effect of the General Principles of the Civil Law on adult guardianship legislation,we have not forgotten to find out the shortcomings and deficiencies in the operation process of the current adult guardianship system;the third part is based on the legislative system,multi-level guardianship measures,intended guardianship regulations,and guardianship supervision systems.It summarizes the relevant system laws and regulations in foreign countries,and tries to find a reference plan that is perfect for China's adult guardianship system.the fourth part,based on the premise of absorbing foreign excellent system regulations,proposes a series of suggestions to make up for the shortcomings and deficiencies of China's current adult guardianship system in accordance with the basic national conditions of our country.
