Research On The Changes In The Legislative Scope Of The Original Larger City After The Amendment Of The Legislation Law

After the amendment of the legislative law,nearly 70%to 80%of the legislative needs of the larger cities that have the legislative power have been restrained.The limitation of the three major issues has made 284 cities in China enjoy the legislative power,but it has also hindered the legislative needs of the larger cities that have obtained the local legislative power before.By combing the existing laws and regulations as well as empirical research,this paper studies the legislative scope of the original larger city after the amendment of the legislative law,in order to summarize and respond to the current situation of the legislative scope of the original larger city,and analyze and put forward practical and operable suggestions to solve the problem.This paper mainly consists of four parts.The first part is a theoretical overview,which mainly includes the theoretical basis,historical origin and legal basis of the legislative power of a city divided into districts.The second part makes a comprehensive analysis of the scope of local legislative authority of a city divided into districts,starting from four parts:the normative interpretation of the scope of legislative authority of a city divided into districts,the change of the legislative authority of a larger city,the legislative practice of a larger city before the amendment of the legislation law,and the problems faced by a larger city after the amendment of the legislation law.The third part takes Ningbo city as a research sample to deeply discuss the achievements and shortcomings of local legislation in Ningbo,which was originally a larger city,and the specific practices and evaluation of local legislation after it was transformed into a "city divided into districts".The fourth part,on the basis of the current laws and regulations,combined with practice evaluation,puts forward targeted measures to improve the local legislative work of the cities divided into districts after the revision of the legislation law,which mainly includes two aspects:the response to the change of the legislative authority of the cities divided into districts,and the Suggestions to improve the legislative authority of the cities divided into districts.
