The Research On Examination And Approval System For Legislation Of Larger Cities

The legislative power of larger cities has been developing with the reforming and opening process of China, and its position can never be neglected in socialist law system with Chinese characteristics. As an organic component of one-subject-with-two-levels legislative system, the legislative power of larger cities has played and is playing an important role in promoting the administration through law and managing local affairs in larger cities due to its great numbers and active performance. One of the most important authorities of provincial Standing Committee of the NPC(National People's Congress) is to examine and approve the legislation of larger cities, which is also a guarantee to protect the uniform of socialist legal system. The examination and approval system for legislation of larger cities has achieved significant effects during the practice. However, there are also some problems which need to be solved in no time.. Therefore, it is necessary to research this system, and put forwards corresponding suggestions and measures.The paper mainly includes five sections:the first section has summarized the current legislative structure in China, and introduced the types of legislative structure, scope of larger cities and definitions of relevant concepts; the second section has discussed three stages of the development of legislative power of larger cities and current situation of examination and approval system for legislation of larger cities; the third section has analyzed the necessity of examination and approval system for legislation of larger cities by explaining the necessity of examination and approval system from various aspects including:protecting the unity of socialist legal system, preventing local protectionism, and guaranteeing the scientificity of local legislation; the fourth section has introduced several different opinions of scholars on this system; the fifth section has analyzed the issues in this examination and approval system, and put forwards the suggestions and measures to improve the examination and approval system for legislation of larger cities from two aspects:legal system and work system.
