Protection And Resource Management Of The Public Domain In The Digital Age

The public domain is known as the thought of promoting the progress and development of human civilization,but our country only listed it in a reasonable use range.Domestic scholars mostly put the public domain into the opposite of copyright,only a few scholars and entrepreneurs pay attention to the protection of the public domain and explore its development.During China's industrial transformation,cultural industry has become an important part of the means of production industry,and cultural industry has become the main driving force of production.In the digital era,with the development of Internet technology,resources can be redeveloped,reused.Data can be reorganized and extended to form more resources,providing a good technical environment and resource environment for the expansion of the public domain.This article through the comparative study method,literature research method to explore the public domain in China and the United States,academic knowledge of public domain in the digital age and definition of legal cases.As well,this article illustrates the regulations in the public domain and the public domain in the digital age the present situation of the expansion or contraction.Finally,according to the result of inquiry to explore China's protection,helping find which solution can take action.The ultimate goal is to show the current situation of the public domain and discuss the protection measures.The text is divided into seven parts.The first part is introduction,which mainly introduces the background of the topic selection of the influence of digitalization on the public domain,and expounds the research status,purpose and significance of digitalization on the public domain,as well as the research methods adopted in this paper.The second part is the definition of public domain and related concepts.This paper discusses the concept of the public domain from the Angle of economy,liberalism and republicanism.The third part discusses the characteristics of the public domain in the digital age.This part mainly introduces the characteristics of public domain resources in the new context by the characteristics of digitalization.The third part is the erosion of intellectual property rights to the public domain in the context of digitalization.According to the results of cases concerning the public domain or intellectual property right after entering the digital age,this paper analyzes the influence of these cases on the public domain.The fifth part introduces the expansion of resources in the public domain under the digital background.This part is divided into two directions.one is actual expansion,the other is false expansion,discussing the reasons of actual expansion and false expansion under the digital background.The sixth part discusses the protection and feasible measures of the public domain,mainly from the two aspects of restricting the irrational expansion of copyright and the management of public domain resources.The seventh part is the summary of the whole article.This paper mainly sunnarizes the main concepts and discusses the practical relationship between the public domain and intellectual property rights.
