Research On Disposal Mechanism Of Disputes About Domain Name

With the rapid development of the Internet around the world,the dissension about domain name has become the focus of the both business circles and the law circles. This paper is going to discuss something about resolving domain name dispute .There are four parts except the preface in this paper.The fist part of this paper, the fist section take the introduction of history and development about domain name as beginning. According the history and development about domain name, the domain name was defined and its characteristic was given. And then the legal nature of domain name is discussed. There are several viewpoints on the legal nature character of domain name. After introducing and analysis those viewpoints, the author give his viewpoints that the domain name is a kind of information property. Next section of this part include introducing the domain name dispute and giving its definition, telling reader some types of domain name dispute and simply analysis the causation of domain name dispute .The second part of this paper, the author choice the international organization or country which has important influence or mature experience on domain name dispute resolution for key.Their domain name dispute resolution mechanism.was introduced and evaluated. The first section introduce and evaluate the WIPO suggestion on domain name dispute resolution. The second section is the introduction of ICANN's domain name dispute resolution mechanism, which Uniform Domain Name Dispute Resolution Policy is core. The third section, the United States' mechanism for resolving domain name dispute is introduced, analysis and evaluation.The third part of this paper are analysis and evaluation of Chinese current domain name dispute resolution mechanism. Then author point out existing problems of domain name dispute mechanism, give advice to perfect domain name dispute resolution mechanism.The fourth part is the last part which review the paper and make a conclusion.
