An Empirical Analysis Of The Factors For Achievement Of Judicial Justice

Based on questionnaire survey and depth interview to get the data analysis,we find that justice implementation status is not optimistic in our country,whose outstanding performance in six aspects:judicial system is not satisfactory;judicial procedure is not perfect;The quality still needs to improve;The judge is of great importance to improve comprehensive quality;The judicial environment remains to be improved;Rationalization and limitation of judicial perfect justice paths exist side by side.Through the use of legal sociology behavioral research paradigm and the Pearson coefficient analysis showed that five factors and the judicial system,judicial proceedings,the judgment quality and the quality of judges,the judicial environment are main factors to realize judicial justice,showed a positive correlation;the judicial system,judicial procedure,quality of the referees judgments publicly and adjudicative document quality of adjudicative document recognition rate,referee illegal rate,the professional ethics of judges,dimensional stability and the letters and visits system of judge,the job security,social rule of law consciousness,leadership and other powers of intervention factors not only positively correlated,and is significantly correlated.Finally put forward five basic countermeasures to further promote the realization of China's judicial justice.This paper is divided into five parts:The first introduction,first on the meaning and value of this paper gives a brief description;And then around the judicial justice,the realization of judicial justice,the influence factors of influence of justice three aspects to carry on the research summary;Finally,the judicial system,judicial proceedings,the judge quality,the quality of judges and the judicial environment defines the five key words.Part ? describes the data used in this paper sources and methods and models,building containing five two-level index of 32 four-level indicators of factors influencing the judicial justice system tables,and the dependent variable(Justice implementation)and independent variables(the five factors of influencing judicial justice)studied the relationship between hypothesis.Part ? through a national survey data analysis of realization summed up China's judicial justice:the Judicial System is Satisfactory in General;the judicial procedure is not satisfactory;Referee quality still needs to be improved;Urgent to improve the overall quality of judges;Judicial environment needs to be improved;Rationalization and limitation of judicial perfect justice paths exist side by side.Part ? using Pearson coefficient calculation of all raw data,confirmed the relevance of each factor and judicial justice,the empirical results show that:(1)from the point of view of the judicial system,judicial system and judicial mechanism of various factors influence judicial justice;(2)the judicial process of rationality,the public and the judicial procedure of judicial procedure effect influence judicial justice;(3)from the quality point of view,the public documents and judgment of legitimacy,judgment of the recognition rate affect the judicial justice,judicial documents and appeals commuted remand rate,effective rate of retrial case commuted and influence on judicial justice has not been proved;(4)from the point of view of the quality of occupation moral quality of judges than judges' professional quality influence judicial justice;(5)in the whole judicial environment,maintaining stability and petition system,the judge's occupation sense of security,social subject consciousness of the rule of law are hindering the realization of judicial justice and the influence of media on judicial justice has not been reflected in this paper.The fifth part put forward five basic strategies promote the full realization of the judicial justice:to trial system and mechanism reform and innovation as the foundation to promote judicial system perfect;to strengthen the breadth and depth of judicial openness as the breakthrough point to promote the judicial process rationalization;in case of quality evaluation evaluation index system to scale to promote the improvement of quality of adjudicative document;to judge professionalism and integrity as the core to improve the comprehensive quality of the judge;to the cultivation of the judicial culture as focal point to improve the legal environment.In a word,this paper empirical methods to analysis influence factors and correlation of the realization of justice,trying to get a table to realize judicial justice system of the influencing factors,so as to China's current judicial system reform suggestions,and promote China's judicial justice.
