Since the late 1990 s,more than 20 years has witnessed the development of non-governmental universities of China.These universities have made significant contributions to China's social progress as well as the economic development,and gradually constituted an important part of the higher education system.With the rise and evolution of non-governmental universities,many unfavorable factors from home and abroad have gradually emerged and become prominent,which have formed a constraint factor preventing the further development of non-governmental universities.In particular,young teachers of non-governmental universities have far less loyalty and sense of identity to their universities due to economic,personal and social causes,compared with those of the public universities.Therefore,how non-governmental universities can increase the loyalty of teachers,enhance their competitiveness & creativity,improve their cultural identity and thereby ensure the consistent elevation of the faculty level by optimizing teachers' selection,salary,teacher career development and university culture construction makes an urgent problem that non-governmental universities need to solve at this stage.From the legal perspective,neither the Labor Law nor the Labor Contract Law directly reflects the words "loyalty obligations" of workers.However,Article 3 Paragraph2 of the Labor Law and Paragraph 23&39 of the Labor Contract Law stipulate that there is a legal basis for workers to fulfill their loyalty obligations,which could be reflected by the contents that workers should strictly abide by relevant disciplines and professional ethics during their work,and should keep confidential the trade secrets during their work.The rules and regulations formulated by the employer must be strictly implemented,and they must be faithful to their own work,not to engage in malpractices or to sign labor contracts with other employers.From the perspective of the loyalty obligations of laborers,this dissertation sets the young teachers of non-governmental universities as the specific research objects,and comprehensively defines the relevant factors that interfere with the execution of teachers' loyalty obligations.The reasons of their loyalty's absence are summarized on the basis of the analysis of the concrete performances of laborers' violation of loyalty obligations,their negative impact and legal consequences accordingly.The comprehensive suggestions for improving the loyalty obligations of laborers and the loyalty and belonging sense of teachers in non-governmental universities are put forward in thisdissertation,which aims to provide legal theory basis and feasible plan for the construction of their high-quality faculty and the healthy development of non-governmental universities of China.
